These Terms & Conditions ("Terms") govern your access to and use of nurturestrike.com and any services provided by NurtureStrike, a division of Derekh Operations LLC ("we," "us," or "our"), a Texas limited liability company. By accessing our website, submitting any form, or using our services, you agree to be bound by these Terms.
NurtureStrike is a proprietary field operations and lead nurture platform available by invitation only. Access is granted exclusively to clients who have entered into a separate service agreement with Derekh Operations LLC. Unauthorized access, reproduction, or distribution of any part of the platform is strictly prohibited.
You agree to use the platform only for lawful purposes and in accordance with these Terms. You may not use the platform in any way that violates applicable federal, state, or local laws or regulations.
NurtureStrike is intended for use by individuals who are 18 years of age or older. By accessing the platform or submitting any form on our website, you represent that you are at least 18 years old.
SMS opt-in data and consent will never be shared with third parties or affiliates for marketing or any other purpose.
By providing your phone number and checking the applicable consent checkbox on our form, you consent to receive text messages from NurtureStrike, a division of Derekh Operations LLC. Two consent types are available:
Transactional SMS: Non-marketing messages including service inquiry responses, appointment confirmations, reminders, and service updates. Message frequency varies.
Marketing SMS: Promotional messages including special offers, discounts, and product updates. Frequency may vary.
Both checkboxes are optional and unchecked by default. Neither is required to submit a form or receive services. Message and data rates may apply.
To opt out of SMS messages at any time, reply STOP to any message. To request help, reply HELP. For all other SMS inquiries, contact [email protected].
NurtureStrike is not liable for delayed or undelivered SMS messages. Delivery of text messages is subject to effective transmission by your mobile carrier. Message and data rates may apply based on your carrier plan.
All content, features, functionality, and design elements of the NurtureStrike platform — including but not limited to text, graphics, logos, workflows, automation sequences, and software — are the exclusive property of Derekh Operations LLC and are protected by applicable intellectual property laws.
Clients are granted a limited, non-exclusive, non-transferable license to use the platform during the term of their service agreement. This license does not include the right to reproduce, distribute, modify, or create derivative works from any platform content.
Clients who access the NurtureStrike platform agree to:
Use the platform only for lawful business purposes
Obtain proper consent from homeowners and contacts before initiating SMS or email communications through the platform
Comply with all applicable federal and state laws including the TCPA, CAN-SPAM Act, and FCC regulations
Maintain the security of their login credentials
Not share platform access with unauthorized users
The NurtureStrike platform and website are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding specific results, revenue, or lead volume from use of the platform.
To the fullest extent permitted by applicable law, Derekh Operations LLC and NurtureStrike shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or these Terms, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the fees paid by you in the thirty (30) days preceding the claim.
You agree to indemnify, defend, and hold harmless Derekh Operations LLC, NurtureStrike, and their respective officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the platform, your violation of these Terms, or your violation of any applicable law or third-party right.
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the data practices described in the Privacy Policy.
We reserve the right to suspend or terminate your access to the platform at any time for any reason, including violation of these Terms. Upon termination, your right to use the platform ceases immediately.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the platform or website after any changes constitutes acceptance of the updated Terms.
All SMS communications sent through or related to the NurtureStrike platform comply with applicable CTIA guidelines and carrier requirements. Opt-in consent is collected separately for transactional and marketing message types. Opt-in data is never sold or shared with third parties. All opt-out requests via STOP reply are processed immediately and permanently.
